Sarah Marie Markiewicz v. David Randal Markiewicz

Stephen L. Borrello Michael J. Kelly Judges

ORDER

Michael F. Gadola Presiding Judge

On the Court's own motion, plaintiff-appellant is directed to file a supplemental brief limited to five pages within seven days of the date of this order advising the Court of the current status of the frozen embryo at issue in this appeal. The Court notes that the trial court awarded possession of the embryo to defendant-appellee on October 28, 2020, and there appears to have been no stay precluding defendant from disposing of the embryo. In the supplemental brief, plaintiff is directed to address whether the embryo is still viable and, if not, why this appeal is not thereby rendered moot.
