Present — Sears, P.J., Crouch, Taylor, Edgcomb and Thompson, JJ.


Judgment and order reversed on the law and a new trial granted, with costs to the appellant to abide the event, upon the grounds stated in the opinion by Taylor, J., in the case of Greiner v. City of Syracuse [ ante, p. 566], decided herewith. All concur, except Sears, P.J., and Crouch, J., who dissent and vote for affirmance.
