Marion v. Pica

District Court of Appeal of Florida, Second District
Aug 18, 1972
265 So. 2d 546 (Fla. Dist. Ct. App. 1972)

Opinion

No. 71-877.

August 18, 1972.

Appeal from Circuit Court, Pinellas County; Charles R. Holley, Judge.

Allen P. Allweiss, St. Petersburg, for appellant.

John G. Fatolitis, Tarpon Springs, for appellee.

Affirmed.

HOBSON, A.C.J., and MANN, J., concur.

McNULTY, J., concurs specially with opinion.

I fully concur in affirming the judgment as to liability in this case, and as to the punitive damages. However, I would order a remittitur in the amount of $310.96, representing the temporary replacement of the damaged personalty, for the reason that a proper predicate was not shown as to its necessity.
