PEDRO SANTIAGO MARIN, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the Criminal District Court No. 7 Dallas County, Texas
Trial Court Cause No. F19-52413-Y

ORDER

We REINSTATE this appeal.

We abated because appellant's brief, due March 2, 2020, had not been filed despite two written notifications from this Court. On May 26, 2020, appellant filed a letter, explaining why the brief had not been filed and noting that the jury charge on guilt/innocence was missing from the clerk's record. In the interest of expediting this appeal, we shall treat the letter as a motion.

We GRANT appellant's motion and ORDER Dallas County District Clerk Felicia Pitre to file a supplemental clerk's record containing the trial court's charge to the jury on guilt/innocence in the above appeal WITHIN FOURTEEN DAYS of the date of this order.

We VACATE our May 18, 2020 order to the extent it ordered the trial court to conduct a hearing to determine why appellant's brief had not been filed. On the Court's own motion, we ORDER appellant's brief due THIRTY DAYS after the supplemental clerk's record containing the guilt/innocence charge is filed.

We DIRECT the Clerk to send copies of this order to the Honorable Chika Anyiam, Presiding Judge, Criminal District Court No. 7; to Dallas County District Clerk Felicia Pitre; to Valencia Bush; and to the Dallas County District Attorney's Office.
