Rehearing Granted Jan. 3, 1941

Appeal from Superior Court, Marin County; Donald Geary, Judge.

Action by the County of Marin against Rodney E. Massner, to recover certain sums of money paid by the county to defendant while he occupied the position of county surveyor. From a judgment for plaintiff, both parties appeal.

Affirmed.
