MEMORANDUM OPINION


On July 16, 2009, the Court notified appellant his brief was deficient, including that it was not signed by counsel. We directed appellant to file an amended brief correcting the deficiencies within ten days. When no amended brief was filed by September 24, 2009, we ordered appellant to file an amended brief correcting the deficiencies noted in the July 16, 2009 letter within ten days. We warned appellant that failure to comply would result in the Court striking the deficient brief and dismissing the appeal. See Tex. R. App. P. 38.9(a), 42.3(c). Appellant has not filed an amended brief.

Accordingly, we strike the appellant's brief filed on May 26, 2009 and dismiss the appeal.
