DECISION & ORDER ON MOTION

Motion by the appellant pro se for leave to appeal to this Court from an order of the Supreme Court, Kings County, dated October 7, 2011, for leave to amend certain records of the Supreme Court, Kings County, for leave to prosecute the appeal as a poor person, for the assignment of counsel, and to waive the motion filing fee.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is to waive the motion filing fee is denied as unnecessary (see 22 NYCRR 670.22[a][2]); and it is further,

ORDERED that the branch of the motion which is for leave to appeal is denied as unnecessary as the order is appealable as of right (see CPLR 5701); and it is further,

ORDERED that the motion is otherwise denied.
