Respondent-respondent having applied for permission to respond to the appeal taken herein from an order of the Family Court, Cattaraugus County, entered in the Office of the Clerk of said Court on December 1, 2010, as a poor person, and for assignment of counsel,

Now, upon reading and filing the certification of Heather A. Tomes, Esq., dated June 10, 2011, the affidavit of Thomas C. Brady, Esq., sworn to June 21, 2011, and due deliberation having been had thereon,

It is hereby ORDERED that the application is granted, and
