Ricardo S. MANCILLAS, Appellant v. The STATE of Texas, Appellee

From the 226th Judicial District Court, Bexar County, Texas

Trial Court No. 2012CR0083B

Honorable Dick Alcala, Judge Presiding

ORDER

Appellant's brief was originally due April 19, 2013; however, the court granted appellant extensions of time to file the brief until June 19, 2013. The brief was not filed. Instead, on that date, counsel filed a motion for an additional twenty-day extension of time, asserting she had just learned that relevant items had been omitted from the clerk's record.

A supplemental clerk's record containing the omitted items has been filed. We grant the motion for extension of time and order appellant's attorney, Julie B. Pollock, to file appellant's brief by July 9, 2013. No further extensions of time will be granted. If the brief is not filed by the date ordered, the court may abate this appeal and remand the case to the trial court for a hearing to determine whether appellant or his counsel has abandoned the appeal.

We further order the clerk of this court to serve this order on counsel by facsimile transmission and by first class United States mail and by certified mail, return receipt requested.

______________

Luz Elena D. Chapa, Justice

IN WITNESS WHEREOF, I have hereunto set my hand and affixed the seal of the said court on this 2nd day of July, 2013.
