Opinion

M.P. No. 1150, APPEAL No. 1144.

September 8, 1970.

The within motion filed on September 3, 1970 prays that a mandatory injunction issue directing the Secretary of State to place the name of the petitioner on the ballot to be used in the Democratic Primary to be held according to law on September 15, 1970. Having been informed by Maurice W. Hendel, Esquire, attorney of record for the Secretary of State, that as of September 3, 1970, it would be impossible to prepare ballots for said primary election containing the petitioner's name in time for use in said primary, the motion therefore is denied and dismissed.
