The reporter's record is past due. By letter dated April 2, 2024, we directed appellant to file, within ten days, notice that he had requested preparation of the reporter's record and cautioned him that failure to comply may result in an order that the appeal be submitted without the reporter's record. See TEX. R. APP. P. 37.3(c). To date, appellant has not complied. Accordingly, we ORDER the appeal be submitted without the reporter's record. See id.

Appellant's opening brief is due July 5, 2024.
