Decided May 3, 2004.

In an action to recover damages for personal injuries, the plaintiff appeals from an order of the Supreme Court, Nassau County (Lally, J.), entered May 21, 2003, which granted the defendant's motion for summary judgment dismissing the complaint on the ground that she did not sustain a serious injury within the meaning of Insurance Law § 5102(d).

Martyn, Toher, Esposito, Martyn, Adler Borsetti, Mineola, N.Y. (Jacqueline R. Sobotta of counsel), for respondent.
