Mahogany v. Stalder

Court of Appeal of Louisiana, First Circuit
Dec 21, 2007
973 So. 2d 176 (La. Ct. App. 2007)

Opinion

No. 2007 CA 0855.

December 21, 2007.

ON APPEAL FROM THE 19TH JUDICIAL DISTRICT COURT, IN AND FOR THE PARISH OF EAST BATON ROUGE STATE OF LOUISIANA DISTRICT COURT NO. 542,779 THE HONORABLE R. MICHAEL CALDWELL, JUDGE PRESIDING.

Richard Mahogany, Jr., Angie, La., Plaintiff/Appellant, In Proper Person.

Debra A. Rutledge, Baton Rouge, La., Counsel for Defendant/Appellee, Richard Stalder.

BEFORE: CARTER, C.J., PETTIGREW and WELCH, JJ.

Plaintiff/Appellant, Richard Mahogany, Jr., an inmate in the custody of the Louisiana Department of Public Safety and Corrections, filed a petition for judicial review of a final agency decision rendered under the Corrections Administrative Remedy Procedure Act. Following de novo review, the district court dismissed plaintiff's petition with prejudice. Mahogany appeals.

The Commissioner's December 12, 2006, report, adopted by the district court in its January 10, 2007, judgment, thoroughly and adequately discusses the factual and procedural background of this case and provides an excellent analysis of the applicable law. Accordingly, we affirm the district court's judgment by summary opinion in accordance with Rule 2-16.2A(5) of the Uniform Rules of Louisiana Courts of Appeal. All costs of this appeal are assessed to the plaintiff/appellant, Richard Mahogany.

AFFIRMED.
