MEMORANDUM OPINION


The Court has before it appellant's agreed motion to dismiss this appeal pursuant to Rule 42.1(a)(1) of the Texas Rules of Appellate Procedure. Appellant states in his motion that the parties have reached an agreement and have settled and compromised all matters in dispute between them arising from the underlying lawsuit and this appeal. The Court hereby grants the motion and dismisses this appeal with prejudice. See Tex. R. App. P. 42.1(a)(1). In accordance with the agreement of the parties as stated in the motion, the costs of this appeal will be taxed against appellant.
