ORDER GRANTING LEAVE TO PROCEED IN FORMA PAUPERIS

BETH LAB SON FREEMAN UNITED STATES DISTRICT JUDGE

Plaintiff, formerly proceeding pro se, filed two similar cases: the instant case and 21-cv-09366-BLF. Plaintiff became represented by counsel on March 25, 2022. (ECF No. 12). The Court ordered Plaintiff to clarify whether he intended to file both lawsuits, and if not, to dismiss the 21-cv-09366-BLF case. (ECF No. 11). Plaintiff, through counsel, dismissed the 21-cv-09366-BLF case. (21-cv-09366-BLF, ECF No. 18). The Court now takes judicial notice of Plaintiff's application for in forma pauperis status filed in 21-cv-09366-BLF at ECF Nos. 9, 10.

In light of Plaintiff's filings in 21-cv-09366-BLF, leave to proceed in forma pauperis is GRANTED. The total filing fee that ultimately will be due is $350.00. No initial filing fee is due at this time. Funds for the filing fee will be taken from income to Plaintiff's account in accordance with 28 U.S.C. § 1915(B)(1). A copy of this order and the attached instructions will be sent to the plaintiff, the prison trust account office, and the court's financial office.
