ORDER ON MOTION TO STRIKE DEFENDANTS' SIXTH, SEVENTH AND EIGHTH AFFIRMATIVE DEFENSES

THIS CAUSE came before the Court on the Plaintiff, Ricardo Machado's Motion to Strike Defendants' Sixth, Seventh, and Eighth Affirmative Defenses, filed on April 4, 2005 (D.E. 10), and upon the Defendants' Notice of Withdrawal of Affirmative Defenses Six, Seven, and Eight, filed on April 1, 2005 (D.E. 9). Accordingly, it is

ORDERED AND ADJUDGED that the Plaintiff's Motion is DENIED as moot.
