MacFadden v. MacFadden

Appellate Division of the Supreme Court of New York, First Department
Nov 24, 1953
282 App. Div. 942 (N.Y. App. Div. 1953)

Opinion

November 24, 1953.

Present — Peck, P.J., Dore, Cohn, Callahan and Botein, JJ.

Order unanimously modified so as to permit the depositions of the witnesses to be taken by written interrogatories. In the circumstances of this case, we find that an open commission would only serve unnecessarily to burden plaintiff with needless expense. Settle order on notice.
