Order and judgment (one paper), Supreme Court, New York County, entered November 27, 1968, which dismissed the cross claim of respondent Attorney-General, unanimously affirmed, without costs, and without disbursements. As conceded by the respondent on the oral argument of the appeal, this determination is without prejudice and not on the merits. As to the stay heretofore entered in this court, CPLR 5519 (subd. [e]) will apply.
