MEMORANDUM OPINION

Bonnie Sudderth, Chief Justice

CORRECTED JUDGMENT

This court has considered the record on appeal in this case and holds that there was no error in the trial court's judgment. It is ordered that the judgment of the trial court is affirmed.

It is further ordered that appellee James M. Shelton shall have and recover of and from appellant M.A. Mortenson Company and its surety, Employers Insurance Company of Wausau, from M.A. Mortenson Company's supersedeas bond, the amounts awarded against appellant and affirmed by this court. We additionally render judgment against Employers Insurance Company of Wausau for all costs of appeal, for which let execution issue.
