ORDER
Before the court are the report and recommendation of the Honorable Nancy S. Nowak, United States Magistrate Judge [Document No. 141], regarding the plaintiffs original request for attorney's fees, expenses and costs [Document No. 108], the plaintiffs amended application [Document No. 125], the plaintiffs supplemental application [Document No. 135], and the plaintiffs segregated application [Document No. 137]. Absent objection or clear error, the court may accept the recommendations of a United States Magistrate Judge in whole or in part. 28 U.S.C. § 636(b)(1)(A); F.R.C.P. 72(b). Where a party makes specific and timely objections to the Magistrate Judge's recommendations, the district court must review de novo those portions of the Magistrate Judge's recommendations to which the party objects. Id.
There being no error apparent in the Magistrate Judge's recommendations, and there being no objections thereto, the recommendations of the Magistrate Judge shall be, and are hereby,
ACCEPTED, in whole. Accordingly, the plaintiffs segregated application for fees shall be, and is hereby
GRANTED, in part. The plaintiff shall be awarded $55,797 as reasonable attorney's fees for its breach of contract claim. In addition, the plaintiffs request for an award of taxable court costs shall be, and is hereby,
GRANTED, in part. The plaintiff shall be awarded $7,549.54 in such costs. Any other requested amounts in the form of trial and appellate attorney's fees and related court costs and expenses made part of the plaintiffs applications shall be, and are hereby,
DENIED.
