APPEAL — Review of Ruling on Motion for New Trial — Motion Not Set out in Brief. — Where the only error assigned is the overruling of the motion for a new trial, and the motion is not set out in appellant's brief, the judgment will be affirmed.

Action by Robert W. Lyons against the Merchants National Bank. From a judgment for defendant, the plaintiff appealed. Affirmed. By the court in banc.

Appellee herein has failed to file any brief, and appellants have petitioned the court for oral argument.
Upon examination of appellant's brief, we find that the only error assigned is that the court erred in overruling appellant's motion for a new trial. Appellant's brief does not contain the motion, nor does it present any other question for our consideration.
The request for oral argument is denied.
Judgment affirmed.
