JUNE TERM, 1788.


LEVY exhibited an account of expences in the execution of a Commission, which had issued for the Plaintiff, ex parte, and moved that they might be allowed in the costs. Besides the charges for swearing the witnesses, and for their attendance on the Commissioners, there were charges for agency, and for the expences of travelling to collect the testimony.

THE COURT allowed the charges for swearing the witnesses, and for their attendance; but rejected those for agency and travelling.
