ORDER


Pending before the Court is Plaintiffs Motion for Leave of Court to Amend Plaintiffs Amended Complaint. Plaintiff Kevin Lynch has filed a complaint alleging unlawful discrimination in employment on the basis of his race and seeking damages of $20 million. Defendant West Group has failed to answer the complaint and is currently in default.

In his Motion to Amend, Mr. Lynch seeks to add "West Publishing Corporation" as a defendant. Mr. Lynch alleges that Defendant West Group was known as West Publishing Corporation prior to 1997, when Thompson Publishing purchased West Publishing Corporation. Insofar as can be determined by Mr. Lynch's filing, he seeks to add the same entity he has already sued, but under a different name. Such filing would be duplicative and an unnecessary use of Court resources.

Therefore, the Motion for Leave of Court to Amend is DENIED without prejudice.
