Order unanimously modified by designating the defendant in place of the receiver named therein, leaving defendant in possession, as receiver, subject to the powers and duties recited in the order on condition that he give an undertaking to be approved by Special Term in the sum of $1,000, and as so modified, affirmed, without costs. Settle order on notice.
