Before the Court is appointed counsel John L. Schomburger's February 22, 2022 motion to withdraw and substitute counsel. In the motion, Mr. Schombrger notes appellant has retained Brett Ordiway for the appeal. We GRANT Mr. Schomburger's request. We DIRECT the Clerk to remove John L. Schomburger and to list Brett Ordiway as retained counsel of record for appellant. All future correspondence shall be sent to Mr. Ordiway at the address on file with the Court.

Although appellant filed a motion for new trial, that filing was untimely to extend the appellate timetable. See Tex. R. App. P. 21.4. Therefore, the reporter's record was due on February 8, 2022. Id. 35.2. When it was not filed, we notified court reporter Antoinette Varela by postcard that the record was past due and directed her to file it by March 14, 2022.

We DIRECT the Clerk to send copies of this order to the Honorable Judge Tom Nowak, Presiding Judge, 366th Judicial District Court; Antoinette Varela, official court reporter, 366th Judicial District Court; Mr. Schomburger; Mr. Ordiway, and the Collin County District Attorney's office.
