Interlocutory judgment reversed upon the law and the facts, with costs, and complaint dismissed, without costs. The finding of the trial court that no copartnership existed between the parties required the granting of the motion for dismissal of the complaint. ( Vincent v. Macbeth, 211 App. Div. 110.)
