LUXOTTICA OF AMERICA INC. F/K/A LUXOTTICA RETAIL NORTH AMERICA INC. AND EYEMED VISION CARE, LLC, Appellants v. JEFFREY GRAY, DAWN GRAY. AND BRAVE OPTICAL, INC., Appellees

On Appeal from the 101st Judicial District Court Dallas County, Texas Trial Court Cause No. DC-17-07929

ORDER

ROBERT D. BURNS, III, CHIEF JUSTICE

This is an accelerated appeal from a temporary injunction. On April 5, 2022, appellants filed a sworn record in lieu of clerk's record. See Tex. R. App. P. 28.1(e). However, they did not seek leave to file the sworn record and were directed by letter dated April 8, 2022 to file either a motion for leave or written verification they had requested the clerk's record. Appellants filed the requested verification on April 11, 2022, and the clerk's record was filed that same day. Accordingly, we STRIKE the sworn record. The appeal shall proceed on the clerk's record.
