Lusunariz v. Moore

District Court of Appeal of Florida, First District
Jun 8, 2000
763 So. 2d 1239 (Fla. Dist. Ct. App. 2000)

Opinion

No. 1D98-3799

Opinion filed June 8, 2000.

Petition for Writ of Certiorari — Original Jurisdiction.

Juan B. Lusunariz, pro se.

Robert A. Butterworth, Attorney General and Wendy Benner-Leon of Assistant Attorney General, Tallahassee, for Respondent.

Juan B. Lusunariz challenges the circuit court's denial of his petition for a writ of mandamus to review the Department of Corrections forfeiture of gain time upon a finding that Lusunariz violated a rule against possession of narcotics. We deny the petition on the ground that Lusunariz has not demonstrated that the circuit court departed from the essential requirements of law.

ERVIN, VAN NORTWICK AND BROWNING, JJ., CONCUR.
