We REINSTATE this appeal.

Before us is appellant's February 5, 2024 fifth motion for an extension of time to file his brief and his tendered brief. We GRANT appellant's motion, and we ORDER appellant's brief filed the date of this order.

Additionally, we VACATE our order issued December 5, 2023, ordering the trial court to conduct a hearing to determine why appellant's brief has not been filed.
