O'BRIEN, M.D., DECEASED, ET AL., DEFENDANTS, AND CATHOLIC HEALTH SYSTEM DOING BUSINESS AS KENMORE MERCY HOSPITAL, DEFENDANT-RESPONDENT.


PRESENT:

Appellant having moved for an extension of time to file and serve a motion for reargument of or, in the alternative, leave to appeal to the Court of Appeals from the order of this Court entered August 20, 2020,

Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted insofar as it seeks an extension of time to file and serve a motion for reargument, on the condition that appellant files and serves the motion on or before November 30, 2020, and

It is further ORDERED that the motion is dismissed insofar as it seeks an extension of time to file and serve a motion for leave to appeal to the Court of Appeals (see CPLR 5514 [c]).
