ORDER

Patrick J. Urda, Judge.

This case is currently calendared on the Court's Jacksonville, Florida trial session, scheduled to begin December 19, 2022.

On October 20, 2022, the Commissioner filed a motion for summary judgment, which was followed by an objection by petitioner George Luniw. We further have permitted the Commissioner to file a reply on or before December 6, 2022. For his part, Mr. Luniw has filed a motion to proceed remotely.

The Court believes that the most appropriate course forward is to strike this case from the above-referenced trial calendar so that it might consider the motion for summary judgment. Given this posture, we will deny without prejudice the motion to proceed remotely, allowing Mr. Luniw to renew the motion should this case ultimately proceed to trial.

Accordingly, it is

ORDERED that this case is stricken from the above-referenced trial session, and jurisdiction is retained by the undersigned. It is further

ORDERED that Mr. Luniw's motion to proceed remotely is denied without prejudice. Should this Court deny the motion for summary judgment and set this case for trial again, Mr. Luniw may renew his request to proceed remotely at that time.
