Supreme Court of Hawaii

Opinion

December 3, 2002.

APPEAL FROM THE DISTRICT COURT OF THE FIRST CIRCUIT WAHIAWA DIVISION (CIV. NO. 1RC02-708)

MOON, C.J., LEVINSON, NAKAYAMA, RAMIL, and ACOBA, JJ.

ORDER DISMISSING APPEAL

Upon consideration of appellees' motion to dismiss appeal, the papers in support and the record, it appears that appellant appeals the district court's April 30, 2002 judgment awarding damages against appellant in Civil No. 1RC02-708, but the judgment is unenforceable by operation of the discharge of debtor filed by the Hawai`i bankruptcy court on August 28, 2002 in appellant's bankruptcy case. Therefore,

IT IS HEREBY ORDERED that the motion to dismiss appeal is granted and this appeal is dismissed as moot.

DATED: Honolulu, Hawai`i December 3, 2002.
