January 14, 1943.

Present — Cunningham, Taylor, Dowling, Harris and McCurn, JJ.


Judgment and orders reversed on the facts and a new trial granted, with costs to the appellant to abide the event, on the ground that the verdict is against the weight of the evidence. All concur, except Harris, J., who dissents and votes for affirmance. (The judgment is for plaintiff in a negligence action. The orders deny defendant's motion for a new trial and resettle said order.)
