FRANK LUCIO, Appellant v. RACHEL ARMENDAREZ, Appellee

On Appeal from the County Court at Law No. 1 Tarrant County, Texas Trial Court Cause No. 2023-007136-1

Panel consists of: Bailey, C.J., Trotter, J., and Williams, J.

ORDER

PER CURIAM

This appeal arises from the trial court's judgment granting possession of the subject property to Appellee in an eviction case. The trial court subsequently issued a writ of possession for the property. Appellant has filed in this court an emergency motion to "bar issuance and/or to dissolve" the writ of possession, which we construe as a request to stay the execution of the writ of possession. In the motion, Appellant states that he has "made all bond deposits required" by the trial court's judgment and "stands ready to make future deposits on a timely basis." Appellant requests that we "[b]ar issuance, vacate, recall or abate, or order the vacation, recall, or abatement or other cancellation of, any writ of possession that might be issued by the County Clerk of Tarrant County."

To preserve the parties' rights, we grant Appellant's motion to the extent that he requests us to stay the execution of the trial court's writ of possession for the subject property. See TEX. R. APP. P. 24.4(c). This stay shall remain in effect pending further orders of this court.

We request that Appellee file a response to Appellant's emergency motion no later than August 16, 2024.
