This case is currently calendared for trial during the Court's March 18, 2024, Houston, Texas, trial session. On February 14, 2024, respondent filed a Motion to Dismiss for Lack of Prosecution (Doc. 12). In the Motion, respondent moves the Court to dismiss the case and find in its order that there is a deficiency in income tax in the amount of $5,985.00 due from petitioner for the 2019 taxable year and that there is penalty under I.R.C. § 6662(a) in the amount of $1,197.00 due from petitioner for the 2019 taxable year. Upon due consideration, it is hereby
ORDERED that, immediately upon receiving this order, but no later than February 26, 2024, petitioner shall telephone Karen Jones, Chambers Administrator of the undersigned judge, at 202-521-0760, for the purpose of scheduling a prompt pretrial telephone conference. It is further
ORDERED that, on or before March 7, 2024, petitioner shall serve on respondent and file with the Court, a response to respondent's Motion to Dismiss for Lack of Prosecution. It is further
ORDERED that respondent's Motion to Dismiss for Lack of Prosecution is set for hearing at the Court's Houston, Texas, trial session scheduled to commence on March 18, 2024, at 10:00 a.m. in Room 7006, 7th Floor, Casey U.S. Courthouse, 515 Rusk Street, Houston, Texas, 77002.
Petitioner is advised that failure to comply with the terms of this Order or failure to appear at the hearing on March 18, 2024, may result in the Court granting respondent's Motion and entering an order and decision against petitioner.
