In Lucas v. Carney, supra (167 Ohio St. 416), the issue was whether construction of a public improvement on county property which greatly increased the amount and the force of surface water which flowed onto the plaintiff's property, overflowing and inundating it, raised a claim of pro tanto appropriation.

Where, in creating a public improvement upon land which it owns, a county without negligence or malice but solely as a result of the creation of such improvement physically encroaches upon the land and property of another owner and deprives that owner of any of the use and enjoyment of his property, such encroachment is a taking pro tanto of the property so encroached upon, for which the county is liable, and the owner of such property is entitled to institute an action and have a jury impaneled to determine the compensation due him from the county for the appropriation pro tanto of his property.

On January 16, 1956, Milton M. Lucas and Clara B. Lucas, hereinafter referred to as Milton and Clara, instituted an action in the Common Pleas Court of Mahoning County against Thomas J. Carney, Edward J. Gilronan and Fred A. Wagner, members of the Board of County Commissioners of Mahoning County, hereinafter referred to as the board, and on the same day, Harry Lucas, hereinafter referred to as Harry, instituted an action in the same court against the same defendants.
In their amended petition, filed March 1, 1956, Milton and Clara allege that they are the owners in fee simple of certain real estate containing approximately one and four-tenths acres of land and fronting on Bears Den Road in the city of Youngstown, and that, prior to the grievances of which they complain, the premises were used as their home, with about three-quarters of an acre of the land being devoted to agricultural purposes and on which they raised sufficient potatoes and vegetables for their own use as well as for sale on the open market.
Other facts alleged in such petition are:
On November 14, 1953, Mahoning County purchased a tract of land containing 8.188 acres for the purpose of constructing thereon a county garage and for public purposes incidental thereto, which tract fronts on the northerly side of Bears Den Road and abuts on the westerly side of Milton and Clara's property.
When the county purchased the tract, it sloped downward easterly, as does the land of Milton and Clara. The grade of the county's land had been kept and maintained for many years in reference and respect to the adjacent lands.
The land of the county was thickly covered with grass and vegetation which dispersed the surface water and retarded its flow, and the surface of the land was sufficiently porous to permit the surface water to sink into the soil, so that no surface water, in harmful quantities, flowed from the county's land onto that of Milton and Clara.
The land of Milton and Clara was improved with a dwelling house, garage and outbuildings, erected and maintained with reference to the established grade of the adjacent land purchased and owned by the county and with reference to the flow of surface water from the county's land and with reasonable reference to the prospective improvement and enjoyment by the owner of the land, and, by reason of the established grade and relative level of the county's adjacent land, the land and buildings of Milton and Clara were useful, and the northern part of such land was devoted to agricultural use, yielding substantial profit.
In the spring of 1954, the board, being a public body entrusted with the control and management of the county's tract of land, changed and altered the grade and surface level of the tract, and, in preparation for the construction of the garage to be used by the county, excavated the westerly portion of the tract and deposited the excavated clay, rock and debris on the easterly portion thereof, making a fill running substantially the entire length of the western boundary of the land of Milton and Clara, which fill, at its highest point, was about 20 feet.
The area cut down and the area that was filled were not left at their former or a level grade but had a sharply accelerated easterly downward grade toward the property of Milton and Clara. Such fill was composed almost entirely of heavy clay, subsoil, rock and debris.
The board caused heavy tractors and dirt-moving machinery, including a large bulldozer, to pass back and forth over the fill so as to compact the earth tightly, with the result that it was made impervious to water, and the natural water of the county's land could no longer sink into the earth, and the greatly increased amount of water was and is ejected with great force and overflows and inundates the property of Milton and Clara during and immediately after every rain and upon the melting of ice and snow.
In the spring of 1954, the board also constructed an underground drain with a fill 36 inches in diameter, 10 feet of which was constructed over and onto the land of Milton and Clara, so that large quantities of surface water, during and after rainstorms and upon the melting of snow and ice, are ejected with great force through the drain and inundate and overflow onto the land of Milton and Clara, where no water in perceptible quantities ever flowed prior to the construction of the fill and drain. Consequently, since the spring of 1954, whenever substantial rains occurred and snow and ice on the county's land melted, the surface water from the county's land, which had not theretofore flowed in any substantial quantities onto the land of Milton and Clara, was ejected with great force onto such land and ran northwardly, overflowing and inundating such land and flooding the cellar of the home and driveway, and into and around the garage and other outbuildings, depositing great quantities of clay, rocks, silt and debris on such driveway and onto the floor of the garage. After Milton and Clara had plowed a portion of their land for agricultural purposes and had planted crops therein, water in large volume was ejected from the drainage tile and flowed eastwardly across the cultivated land, causing furrows and washing out the top soil to a width of 10 feet and to a depth of 18 inches, causing the land of Milton and Clara to become permanently unfit for agricultural purposes and destroying the crops already planted therein.
The surface water, flowing as hereinbefore described and depositing the debris, washed out several tons of slag and cinders, with which the driveway of Milton and Clara had been constructed, and deposited such slag and cinders and other debris over other portions of the property of Milton and Clara and into the cellar of the home and into and around the other buildings, permanently damaging the interior and foundation of the buildings, as well as the tools and equipment stored therein.
In the fall of 1954, after the first inundation of the land and buildings of Milton and Clara, the board built a concrete retaining wall on the toe of the slope of the fill, extending southerly from the north boundary of the county's land 600 feet and along the westerly boundary of the land of Milton and Clara, with a foundation and footer extending three feet below the surface of the ground and 18 inches wide. Above the footer and foundation the main retaining wall was erected 54 inches high and one foot thick, and, before such construction, water percolated through the subsurface of the county's land into the land of Milton and Clara, thereby making possible its value and use for agricultural purposes. However, after the building of such footer and retaining wall, such percolation of water was wholly cut off, thereby destroying the use of the land of Milton and Clara for agricultural purposes.
The wall has proved wholly ineffective to retain and divert the repeated and excessive flow of surface water from the county's land or to prevent the washing of clay, rocks, and other debris onto the land of Milton and Clara.
The board's actions constitute a continuing encroachment upon and a permanent taking of substantial property rights in the lands of Milton and Clara, which the county can not prevent except by discontinuing the use of its land for a garage, which it will not do.
Milton and Clara have the right to hold and enjoy their lands as aforesaid, improved and without substantial change or alteration in relation to the former level of the county's land, subject only to the county's right of eminent domain in respect to property taken by it for public use, such authority to be exercised only in the manner provided by law after suitable and adequate compensation is first made in money for the deprivation of private rights and property.
The board proceeded to make the changes and alterations, as herein alleged, without notice to Milton and Clara, without having paid any compensation in money for the taking of substantial rights in their land, without having caused a jury to fix and award to them such compensation to which they are entitled, and without having in any manner provided any means or tribunal to ascertain and assess compensation for the taking of their property by the county.
In the prayer of the petition, Milton and Clara say they are entitled to have a jury assess their compensation, and that compensation is due them in the sum of $4,000, for which they ask judgment. They pray also for such other and further relief at law or in equity to which they may be entitled.
Harry alleges in his amended petition that he was the owner of certain building material and equipment stored upon the real estate owned by Milton and Clara, which building material is alleged to have been of a reasonable value of $1,419.71. Thereafter, he makes substantially the same allegations as to the board's actions as are made in the amended petition of Milton and Clara, and alleges that, as a consequence of the water, mud, slag, stone and debris which ran over and around his building materials and equipment, they were completely covered and imbedded, with the result that they were destroyed.
In his prayer Harry says that he is entitled to have a jury assess his compensation, and that there is due him $1,419.71, for which amount he asks judgment and for such other and further relief at law or in equity to which he may be entitled.
To each of the amended petitions, the board filed a demurrer upon the ground that it appears upon the face of the petition that the facts therein contained do not constitute a cause of action in favor of the plaintiffs and against the board.
The Court of Common Pleas sustained both demurrers and rendered judgments against Milton and Clara and against Harry.
Appeals were taken to the Court of Appeals, where the causes were consolidated, since it was deemed that the issues in both were the same, and that court, with one judge dissenting, affirmed the judgments of the Court of Common Pleas.
The causes are in this court on appeals as of right and by reason of the allowance of motions to certify the records.

The issue presented in these cases is whether a county is liable for an invasion and taking of the substantial property rights of a person by an act of such county strictly within the scope of its authority and unattended by any circumstances of negligence or malice.
The majority of the Court of Appeals was of the opinion that the amended petitions do not allege a taking of the property of Milton, Clara and Harry, either pro tanto or in toto, and that there can be no liability upon the part of the county in the present cases, since this court has held that an action in tort may not be brought against a county for negligence in the performance of a public duty resulting in a private injury, in the absence of a statute authorizing such action, and that a governmental authority is not liable for consequential damages resulting to adjoining property in condemnation proceedings.
Beginning with the case of Board of Commissioners of Hamilton County v. Mighels, 7 Ohio St. 109, this court has consistently held that a county is not liable for the negligent acts of its officers, in the absence of a statute creating such liability, and has held that there is no liability in condemnation proceedings for consequential damages to adjoining property. Smith v. Erie Rd. Co., 134 Ohio St. 135, 16 N.E.2d 310.
However, from a perusal of the authorities, it seems that by consequential damages is meant the lessening of the value of property adjoining land which has been condemned, because of the use to which the land condemned has been subjected. However, this court has maintained, without equivocation, that if property is taken by a governmental authority, either completely or pro tanto, Section 19 of Article I of the Ohio Constitution guarantees a right of compensation to the owner of the property so taken.
In the case of City of Norwood v. Sheen, Exr., 126 Ohio St. 482, 186 N.E. 102, 87 A.L.R., 1375, the first two paragraphs of the syllabus read as follows:
"1. Any direct encroachment upon land, which subjects it to a public use that excludes or restricts the dominion and control of the owner over it, is a taking of his property, for which he is guaranteed a right of compensation by Section 19 of the Bill of Rights. ( Lake Erie Western Rd. Co. v. Commissioners of Hancock County, 63 Ohio St. 23, approved and followed.)
"2. A petition set forth in substance the erection, by private parties, of a sewer under the surface of a street in a private subdivision, all of the drainage from which street flowed onto the premises of the plaintiff's decedent; that such street was subsequently dedicated to a certain city and accepted by such city for street purposes; that such sewer was controlled and maintained by such city as part of its public sewer system; and that such city so used such sewer and drainage facilities as to cause the flooding and pollution, with filth, excrement, waste, drainage and unwholesome water, of such land for a period of some four years. The petition further showed that the city, at the end of such period, built a proper storm and sanitary sewer and abated the condition theretofore existing. Held, that such petition states a cause of action against such city for temporary appropriation of private property to a public use."
In her opinion in that case, Judge Allen cited with approval 10 Ruling Case Law, 66, Section 58, which reads as follows:
"If the land, `in its corporeal substance and entity,' is property, still, all that makes this property of any value is the aggregation of rights or qualities which the law annexes as incidents to the ownership of it. The constitutional prohibition must have been intended to protect all the essential elements of ownership which make property valuable. Among these elements is, fundamentally, the right of user, including, of course, the corresponding right of excluding others from the use. A physical interference with the land, which substantially abridges this right, takes the owner's property to just so great an extent as he is thereby deprived of his right. To deprive one of the use of his land is depriving him of his land; and the private injury is thereby as completely effected as if the land itself were physically taken away. Accordingly it has been held that any use of land for a public purpose, which inflicts an injury upon adjacent land such as would have been actionable if caused by a private owner, is a taking within the meaning of the Constitution and can not be authorized by the Legislative without compensation."
In the case of Smith v. Erie Rd. Co., supra, the first paragraph of the syllabus reads:
"Under Section 19, Article I, of the Constitution, which requires compensation to be made for private property taken for public use, any taking, whether it be physical or merely deprives the owner of an intangible interest appurtenant to the premises, entitles the owner to compensation."
In the opinion, Judge Williams quoted from the case of City of Mansfield v. Balliett, 65 Ohio St. 451, 63 N.E. 86, 58 L.R.A., 628, as follows:
"The value of property consists in the owner's absolute right of domain, use, and disposition for every lawful purpose. This necessarily excludes the power of others from exercising any dominion, use or disposition over it. Hence, any physical interference by another, with the owner's use and enjoyment of his property, is a taking to that extent. To deprive him of any valuable use of his land is to deprive him of his land, pro tanto. So that, the principle of the Constitution is as applicable where the owner is partially deprived of the uses of his land, as where he is wholly deprived of it. Taking a part is as much forbidden by the Constitution as taking the whole."
Judge Williams also stated in his opinion:
"In some of the early cases in this country, the courts, adhering to the conception of property as the thing owned, construed the taking alluded to in state Constitutions to be a `taking altogether,' an appropriation and dispossession of the owner, which deprived him of the corpus of the property, and compensation was limited accordingly. The broader view, which now obtains generally, conceives property to be the interest of the owner in the thing owned, and the ownership to afford the owner the rights of use, exclusion and disposition. Under this broad construction there need not be a physical taking of the property or even dispossession; any substantial interference with the elemental rights growing out of ownership of private property is considered a taking."
If Milton and Clara and Harry in their amended petitions had simply claimed a taking of their property because its value had been lessened without other interference or physical encroachment upon it, doubtless their claims would have been denied as damnum absque injuria, but from the allegations in the amended petitions, it is quite apparent that plaintiffs are alleging that there has been a substantial interference with their elemental rights growing out of the ownership of private property. They allege the various acts of interference and charge a taking of their property, at least pro tanto. They do not claim that the board was negligent or did anything other than its rightful duty, but, nevertheless, plaintiffs claim that the board has taken their property rights as a necessary incident to the performance of a public function. Under such circumstances, Section 19, Article I of the Constitution, requires just compensation to be paid to the property owners.
In the case of Harry, the property was personal, but Section 19, Article I of the Ohio Constitution, makes no distinction between real and personal property. It provides:
"Private property shall ever be held inviolate but subservient to the public welfare. * * * and * * * where private property shall be taken for public use, a compensation therefor shall first be made in money, or first secured by a deposit of money; and such compensation shall be assessed by a jury, without deduction for benefits to any property of the owner."
It must be remembered that the present actions are not based upon either negligence or upon the maxim, sic utere tuo ut alienum non laedas, which, translated, means, so use your own that you do not injure that of another. They are based solely upon the doctrine of appropriation by encroachment.
The cases are legion to the effect that a taking under the power of eminent domain does not include the personal property lying on the premises taken but not affixed thereto, and that damages for injury to such personal property or the expense of removing it from the premises taken is not a proper element of compensation. The reason for this rule is that in an appropriation proceeding the specific property taken is designated and all other property is excluded, so that one may have compensation only for the property taken and for any damage to the residue.
In the present cases, however, according to the language of the amended petitions, the encroachment by reason of the improvements upon the county's property deprives the owners of the adjoining property of the use of their property, and to that extent that property is taken pro tanto, not only as to the realty but as to the personal property rightfully thereon.
There is very little authority concerning the taking of personal property under the circumstances of the present cases, but we call attention to the case of Superior Coal Builders Supply Co. v. Board of Education of Dayton, Ky., 260 Ky. 84, 83 S.W.2d 875, where it is stated as follows:
"These parties own land near each other in the city of Dayton, their properties are both drained by the same natural watercourse; the land of the defendant being about 150 feet down stream from that of the plaintiff. In the petition it is alleged:
"`The defendant early in the year 1933 altered and changed the grade and topography of its said real estate, and substituted for a natural watercourse thereon, a drain of such insufficient and small dimensions as to cause water to accumulate in large quantities during heavy rainfalls, and to be discharged upon plaintiff's said real estate, flooding the same and destroying the commodities stored thereon.'
"The defendant contends that the action of the trial court is correct because its property does not adjoin that of the plaintiff, because it is an arm of the state, and because it has no money except that raised by taxation for specific governmental purposes which can not be diverted. Ky. Const., Section 180. That is true, but if it has taken in whole or in part the property of its neighbor, it must pay therefor (Sections 13 and 242, Ky. Const.), even though it must raise by taxation the money to do so. Whether these properties adjoin or not is not the charge plaintiff tried to make, but that defendant took the plaintiff's property, and, so far as its being an arm of the state is concerned, it is still responsible if it took the plaintiff's property. The Constitution was written to protect the citizen from the improper acts of the state, its arms and its officers; nor does it make any difference that a portion of the plaintiff's property was personal property, as Sections 13 and 242, Ky. Const., apply to both real and personal property."
In the present cases, we are dealing with demurrers to amended petitions and, therefore, cannot forecast what the evidence will be upon the trial of these cases, whether the evidence produced will show that the property of plaintiffs was not damaged by the actions of the county, or that the damage resulted solely from a vis major, or any other facts which may relieve the county of liability. We are simply deciding that the demurrers to the amended petitions should have been overruled.
We are in accord with the following language of Judge Nichols of the Court of Appeals in his dissenting opinion in the present causes:
"Candor, however, compels me to state that confusion has been injected into this case by counsel for the respective plaintiffs by reason of the language contained in the prayer for relief, which language may have induced the majority members of this court to believe that each action against the county commissioners was one for damages arising out of tort. The per curiam [ sic] opinion so states.
"Reference to the prayer of each petition does disclose that the plaintiffs are asking for judgment in the respective amounts stated therein.
"It is quite clear that such prayer for judgment is not a proper prayer conformable to the allegations of each petition. The prayer should have been merely for the impaneling of a jury to assess the amount of compensation to which the jury finds each plaintiff is entitled by reason of the alleged appropriation pro tanto of property of the respective plaintiffs.
"Upon consideration of a demurrer to a petition the court will look only to the allegations of fact stated therein, without reference to the prayer, in determining whether the petition states a cause of action for some relief prayed for therein.
"The prayer in each of these petitions does ask `for such other and further relief at law or in equity as to which they (or he) may be found entitled.' Under such general prayer for relief the plaintiffs were entitled to have a jury impaneled to determine the compensation due them for the appropriation pro tanto of their respective properties."
The judgments of the Court of Appeals are reversed, and the causes are remanded to the Court of Common Pleas for further proceedings in accordance with this opinion.
Judgments reversed and causes remanded.

So far as the action of Milton and Clara Lucas is concerned (case No. 35217) I concur in the judgment reversing the judgment of the Court of Appeals, but I regard it as unfortunate that neither the majority opinion nor any opinion in the cases it cites has even endeavored to distinguish or notice Board of County Commissioners of Portage County v. Gates, 83 Ohio St. 19, 93 N.E. 255, or Grimwood v. Commissioners of Summit County, 23 Ohio St. 600, cited by the defendant county.
In the petition in the case of Milton and Clara it is alleged that "what was done by defendant county constituted a continuing trespass upon plaintiffs' land which defendant * * * could not prevent except by discontinuing the use of said land for a garage, which it will not do"; and the facts alleged in their petition justify that conclusion.
Notwithstanding the suggestion in the syllabus to the contrary, I believe that the facts in plaintiffs' petition in that case would state a cause of action against the county even if plaintiffs had alleged that the county had negligently or maliciously physically encroached upon their land and thereby deprived plaintiffs of the use and enjoyment of such land. Also, I believe that it is essential to the statement of a cause of action that there should be allegations, and there are, indicating not only an encroachment for a substantial period of time on the plaintiffs' land but a full realization by the defendant county that it was so continually encroaching thereon, and not merely allegations indicating a sudden and unrepeated damage to the property as alleged in the action by Harry Lucas, — a damage as transitory as might be caused by a collision of a plaintiff's automobile with an automobile of the defendant county being operated in the performance of a governmental function. Cf. Causby v. United States, 75 F. Supp., 262, where "the destruction" held to be a "taking" was "the natural consequence of the deliberate, intended exercise of an asserted power."
However I cannot agree with the conclusion summarily reached in the majority opinion that, because Section 19 of Article I of the Ohio Constitution makes no distinction between real and personal property, Harry Lucas's petition (case No. 35218) states a cause of action. The Court of Appeals of Kentucky may have reached a similar conclusion in 1935 but it cites no authority for its conclusion, gives no reasons therefor, and its decision reaching that conclusion has never until now been judicially noticed.
Of course, there may be a "taking of" personal property within the meaning of Section 19 of Article I of the Ohio Constitution, but the question in the instant case is not whether there can be such a "taking" but whether there was such a "taking" of personal property.
In the amended petition of Harry Lucas, he alleges that he "was the owner of certain building material and equipment stored upon real estate owned * * * by Milton * * * and Clara * * * Lucas"; "that defendant county * * * purchased * * * land * * * for the purpose of erecting thereon a county garage and for other public purposes incident thereto [all such purposes being admittedly governmental purposes], which * * * abuts on" said real estate of Milton and Clara; "that in the spring of 1954 defendant * * * in preparation for the construction" of such garage made excavations and fills on its land so "that the area of defendant's land cut down and the area that was filled was not left at its former or at a level grade, but thereafter had a sharply accelerated easterly downward grade toward the property upon which plaintiff's building materials and equipment" were located; that defendant so compacted the earth as to make it "impervious to water so that the natural surface water collecting on defendant's land could no longer sink into the earth, but * * * by reason of the accelerated slope * * * toward the east, the flow of surface water during and immediately after a rain * * * was very greatly increased and * * * ejected with great force onto and overflowed and inundated the property upon which plaintiff's material and equipment was located"; and "that on June 18, 1954, as the result of a very heavy rain which fell upon the land of the defendant, the surface water collected thereon was ejected with great force from the land of the defendant onto the land whereon plaintiff's material and equipment were located and carried with said water, mud, slag, stone and debris which ran onto, over and around said materials and equipment, completely covering and imbedding the same in mud, slime and debris, destroying and making said material and equipment unfit for use and worthless."
Admittedly, what defendant county was doing on its property was lawful and there are no allegations with respect to any negligence of such defendant. It is apparent therefore that the petition would state no cause of action against a defendant that did not enjoy the immunity from suit of a Board of County Commissioners.
Thus in O'Day v. Shouvlin, 104 Ohio St. 519, 136 N.E. 289, 25 A.L.R., 980, the syllabus reads in part:
"The maxim, sic utere tuo ut alienum non laedas, is not a hard and fast rule applied, under all circumstances, to the use of property by adjoining proprietors. If the business is lawful, and the facilities employed are not inherently noxious or dangerous, but are operated by means of modern appliances in the usual and ordinary method, such business is not a nuisance per se, nor is its owner liable as an insurer.
"A petition alleged that the defendant was the owner of a plant employing a cupola for its operation; that the cupola was 218 feet distant from plaintiff's dwelling house; that in its operation sparks escaped from the cupola and, carried by wind blowing in the direction of plaintiff's dwelling, destroyed it. Held: In the absence of allegations of negligence, the petition was demurrable."

If the petition in the instant case would not even state a cause of action for damages against a defendant that did not enjoy the immunity from suit of a Board of County Commissioners, how could it be considered as stating a cause of action against such a board, and how could the facts alleged in that petition involve a "taking" of the personal property damaged within the meaning of Section 19 of Article I? As stated in 2 Nichols on Eminent Domain (3 Ed.), 285, Section 6.38:
"That a use of land which, though causing injury to the neighboring land, would not be actionable at common law, — in other words, a use that would not constitute a private nuisance, — is not a taking is universally conceded to be true. When, however, the injury is of a kind which would create liability at common law a more difficult question arises."
There are not even any allegations in the petition that defendant county took possession of, got any benefit from, used or otherwise appropriated plaintiff's materials and equipment. See Pontiac Improvement Co. v. Board of County Commrs. of Cleveland Metropolitan Park District, 104 Ohio St. 447, 135 N.E. 635, 23 A.L.R., 866; May v. Board of Commrs. of Logan County, 30 F., 250; 2 Lewis on Eminent Domain (3 Ed.), 1277, Section 728; 2 Nichols on Eminent Domain (3 Ed.), 212, Section 5.84; and Orgel on Valuation under Eminent Domain (2d), 12, Section 3.
In 1 Lewis on Eminent Domain (3 Ed.), 51, Section 62, it is said:
"In regard to personal property, no question can ordinarily arise. It is seldom necessary to appropriate it, but if appropriated, it is taken; if not appropriated, it can be removed beyond the influence of any particular improvement and so escape the deterioration or injury it might otherwise sustain."
As stated in 18 American Jurisprudence, 895, Section 255:
"A taking by eminent domain does not include the personal property lying on the premises taken, but not affixed thereto; and it is well settled in most jurisdictions that damages for injury to such personal property or the expense of removing it from the premises taken are not proper elements of compensation."
