Nicholas LUCANEGRO, Appellant/Petitioner(s), v. STATE of Florida, Appellee/Respondent(s).

Opinion

BY ORDER OF THE COURT.

The petitioner's petition alleging ineffective assistance of appellate counsel alleges ineffective assistance of the petitioner's postconviction appellate counsel in appeal 2D13–4607. As this category of petition is not available to challenge postconviction appellate counsel's effectiveness, the petition is dismissed. See Fla. R.App. P. 9.141(d)(5) (indicating that such a petition is available to challenge direct-review counsel's effectiveness); cf. Hunter v. State, 48 So.3d 836 (Fla.2010).
