LRF1 DALLAS LOGISTICS 1 LLC, Appellant v. CITY OF CARROLLTON AND BRETT KING, BUILDING OFFICIAL OF THE CITY, IN HIS OFFICIAL CAPACITY, Appellees

On Appeal from the 14th Judicial District Court Dallas County, Texas
Trial Court Cause No. DC-19-09123

ORDER

On May 12, 2020, after appellant informed the Court the parties had settled their dispute but the settlement agreement had to be approved by the City Council, we ordered appellant to file its brief or a motion to dismiss the appeal by May 22, 2020. By joint motion filed May 20, 2020, the parties inform the Court the settlement has been approved but certain terms of the agreement must be satisfied before the appeal can be dismissed. The parties request the appeal be stayed and the deadline for filing appellant's brief be extended to the earlier of October 26, 2020 or ten days after any party informs the Court the settlement agreement has been breached.

We GRANT the motion to the extent we ABATE the appeal. The appeal will be reinstated, and, if necessary a deadline for the filing of appellant's brief will be set, no later than October 26, 2020 or upon motion by any party.
