Avie Lee LOZANO, Appellant v. THE STATE OF TEXAS, Appellee

From the 226th Judicial District Court, Bexar County, Texas
Trial Court No. 2016CR8489
Honorable Sid L. Harle, Judge Presiding

ORDER

On May 22, 2017, we abated this appeal and remanded it to the trial court to conduct a hearing to determine whether appellant still desires to prosecute his appeal, whether counsel has abandoned the appeal, and to appoint new counsel if warranted. On June 7, 2017, appellant appeared in person before the trial court. Although he had been given notice of the hearing, appellant's court-appointed counsel, David Hesse, failed to appear.

At the conclusion of the hearing, the trial court removed attorney David Hesse from the appeal and appointed Adam Kobs to represent appellant in this appeal. A supplemental record containing the reporter's record of the hearing and the trial court's findings of fact and conclusions of law has been filed in this court. The trial court found that appellant still desires to prosecute this appeal, but that Hesse has abandoned the appeal.

We reinstate this appeal on the docket of the court and adopt the findings and conclusions of the trial court. We order appellant's brief due July 14, 2017.

IN WITNESS WHEREOF, I have hereunto set my hand and affixed the seal of the said court on this 14th day of June, 2017.
