KAREN LORENA LOZANO, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the County Criminal Court at Law No. 6 Harris County, Texas
Trial Court Cause No. 2006270

MEMORANDUM OPINION

Appellant, Karen Lorena Lozano, has filed a motion to dismiss the appeal. The motion complies with Texas Rule of Appellate Procedure 42.2(a) except it is not signed by appellant. See TEX. R. APP. P. 42.2(a). However, an appendix to the motion includes the trial court's findings after conducting a hearing to determine if appellant still wanted to prosecute the appeal. The trial court found that appellant "did not want to prosecute the appeal any further, wanted to withdraw the appeal, and expressed the desire to be relieved of any more duties or responsibilities of the court, and the appellate court." The trial court recommended that appellant's appeal be withdrawn and removed from the appeals court docket. In light of the foregoing, we suspend the portion of rule 42.2(a) that requires appellant to sign the motion to dismiss. See TEX. R. APP. P. 2. We have not issued a decision in the appeal.

Accordingly, we dismiss the appeal. See TEX. R. APP. P. 43.2(f). We dismiss any pending motions as moot.

PER CURIAM Panel consists of Justices Chief Justice Radack and Justices Brown and Lloyd. Do not publish. TEX. R. APP. P. 47.2(b).
