Court of Appeals of Texas, Fourth District, San Antonio
Feb 7, 2007
No. 04-06-00653-CV (Tex. App. Feb. 7, 2007)

Opinion

No. 04-06-00653-CV.

Delivered and Filed: February 7, 2007.

Appealed from the 216th Judicial District Court, Kerr County, Texas, Trial Court No. 03-204-A-1 (Severance from Trial Court No. 03-240-A), Honorable Stephen B. Ables, Judge Presiding.

Sitting: PHYLIS J. SPEEDLIN, Justice, REBECCA SIMMONS, Justice, STEVEN C. HILBIG, Justice.

MEMORANDUM OPINION

DISMISSED

The clerk's record, which was originally due on October 23, 2006, has not been filed. On November 15, 2006, this court notified the trial court clerk that the clerk's record was late. The trial court clerk responded by filing an amended notification of late record stating that the clerk's record was not filed because appellants had failed to pay or make arrangements to pay the clerk's fee for preparing the record, and appellants are not entitled to appeal without paying the fee. On December 18, 2006, this court ordered appellants to show cause in writing by December 28, 2006, why this appeal should not be dismissed for want of prosecution. Appellants did not respond. Accordingly, the appeal is dismissed for want of prosecution. See Tex. R. App. P. 37.3(b). Costs of the appeal are taxed against appellants.
