By order of July 28, 1998, the delayed application for leave to appeal from the October 13, 1997 decision of the Court of Appeals was held in abeyance pending the decision in Robinson v City of Detroit (Docket No. 110360) and Cooper v Wade (Docket No. 107421). On order of the Court, the decision having been issued on July 18, 2000, 462 Mich. 439 (2000), the delayed application is again considered and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we REMAND the case to the Court of Appeals for reconsideration in light of Robinson andCooper.

Young, Jr. and Markman, JJ., not participating.
