ORDER

Between November 1, 2024, and December 6, 2024, this Court has received three letters from Kristen Pullen, who alleges that she is appellee Jontelle Yvette Mitchell. She seeks relief from this Court in this appeal.

Because we are unable to determine whether the person sending letters under the name "Kristen Pullen" is a disinterested non-party or appellee Jontelle Yvette Mitchell, we abate this appeal and remand the cause to the trial court for further proceedings. The trial court is ordered to:

(1) conduct a hearing within 60 days to determine whether the person sending letters to this Court in this case under the name "Kristen Pullen" has an interest in this case;
(2) determine any other issues that the trial court may deem necessary for the proper adjudication of this appeal;
(3) enter written findings of fact, conclusions of law, and recommendations as to these issues, separate and apart from any docket sheet notations.

The trial court shall have a court reporter, or court recorder, record the hearing. The trial court clerk is directed to file a supplemental clerk's record containing the written findings of fact, conclusions of law, recommendations, and further orders of the trial court with this Court no later than 30 days from the date of the hearing. See Tex. R. App. P. 34.5(c)(1). The court reporter is directed to file the reporter's record of the hearing within 45 days of the date of the hearing. See Tex. R. App. P. 34.6 (d).

The appeal is abated, treated as a closed case, and removed from this Court's active docket. The appeal will be reinstated on this Court's active docket when the supplemental clerk's record is filed with the Clerk of this Court. The trial court shall set a hearing date and notify the parties and Kristen Pullen.

It is so ORDERED.
