600 So. 2d 692 (La. 1992)

Opinion

No. 92-CC-1996.

July 14, 1992.

In re Louisiana Health Care Auth.; Murrill, M. Melvin, M.D.; Mintz, Donald Richard; — Plaintiff(s); applying for supervisory and/or remedial writs; Parish of East Baton Rouge, 19th Judicial District Court, Div. "D", No. 382, 800; to the Court of Appeal, first Circuit, No. CW92 1291.

Denied on the showing made.

HALL, J., would grant the order in part and order the district court to hold a hearing on the preliminary injunction within 10 days. LSA C.C.P. arts. 3602, 3606.

Conducting of the July 9th hearing stayed by the court of appeal is now moot. The district court is free to consider anew the granting of a temporary restraining order and the setting of a hearing on the preliminary injunction. Defendant's exceptions, if any are filed, should be considered at or prior to the hearing on the preliminary injunction.
