Opinion

November 2, 1942.

Action against a dentist to recover damages for alleged malpractice in the extraction of a tooth under an anesthetic, and for loss of services. Judgment entered on the dismissal of the complaint at the close of the plaintiffs' case reversed on the law and a new trial granted, costs to abide the event. We believe the evidence in plaintiffs' behalf was sufficient to establish a prima facie case. Lazansky, P.J., Carswell, Johnston, Adel and Close, JJ., concur.
