SECOND STIPULATION AND ORDER FURTHER EXTENDING STAT PENDING RECONSIDERATION BY THE DISTRICT COURT OF LACERNA'S MOTION TO COMPEL COMPLIANCE WITH FIFTH SET OF REQUESTS FOR DOCUMENTS


The Plaintiff LACERA and the defendant Towers, Perrin, Forster Crosby, Inc. ("TPFC"), by their counsel, hereby stipulate and agree as follows:

1. On January 6, 2003, Magistrate Judge Margaret A. Nagle signed the Stipulation and Order Extending Stay Pending Reconsideration by to District Court of LACERA's Motion to Compel Compliance With Fifth Set of Requests for Documents, which extended the stay issued by Magistrate Nagle on December 23, 2002 from January 6, 2003 until January 27, 2003, the date scheduled for to hearing on Towers Perrin's Motion for Reconsideration before Judge Pregerson.

2. On January 22, 2002, Judge Pregerson on his own motion Issued an order vacating the January 27, 2003 hearing on Towers Perrin's Motion for Reconsideration and taking that Motion under submission.

3. As a result, the parties hereby stipulate and apes that the stay Issued by the Magistrate Judge shall be and hereby is extended trough the entry date of Judge Pregerson's ruling on the Motion for Reconsideration; and, in the event the Motion for Reconsideration is denied, the test valuation process shall commence within seven calendar days after the entry date of Judge Pregerson's ruling, a on an alternative date agreed to by the parties.

ORDER

IT IS HEREBY ORDERED THAT the stay issued by the Magistrate Judge shall be and hereby is further extended through the entry date of Judge Pergerson's ruling on the Motion for Reconsideration; and, in the event the Motion for Reconsideration is denied, the test valuation process shall commence within seven calendar days after the entry date of Judge Pergerson's ruling, or on an alternative date agreed to by the parties.
