MARC LORE & CAROLYN LORE, Petitioners v. COMMISSIONER OF INTERNAL REVENUE, Respondent
ORDER
Courtney D. Jones Judge
This case is on the calendar of the Court's May 20, 2024, trial session in New York City, New York. On February 21, 2024, respondent filed a Motion for Continuance. By Order dated February 26, 2024, the Court directed petitioners to file a response to respondent's motion. Petitioners filed a Response on March 15, 2024.
In the motion, respondent requests that the undersigned retain jurisdiction and specially set this case for trial during a week in November 2024. The motion further advises that the parties anticipate a trial of 7 to 8 days. In their response, petitioners state that subject to the availability of the Court, a shorter continuance of three or four months until August or September 2024 would enable all parties to prepare for trial and "that a further delay beyond that date is both unwarranted and burdensome to Petitioners."
The Court expects the parties to work cooperatively and expeditiously to prepare the case for trial. If the parties need a special trial session, they can jointly request it. They should be aware that the Court and the undersigned can accommodate a special trial session in January to May 2025 in Washington, D.C. If the parties make such a request, the Court expects them to include at least three proposed trial dates for the special trial session to begin in January to May 2025 in Washington, D.C., stipulate the estimated length of trial, and provide a proposed pretrial schedule. Upon due consideration, it is
ORDERED that respondent's Motion for Continuance (Doc. 9) is granted in that this case is stricken from trial at the aforementioned trial session and is continued. Jurisdiction is retained by the undersigned. It is further
ORDERED that on or before May 20, 2024, the parties shall file a status report (jointly if possible, otherwise separately) that provides the Court with an overview of the status of this case.
