Mar 16, 2005
895 So. 2d 1282 (Fla. Dist. Ct. App. 2005)

Opinion

No. 3D04-1741.

March 16, 2005.

An Appeal under Florida Rule of Appellate Procedure 9.141(b)(2) from the Circuit Court for Miami-Dade County, Pedro P. Echarte, Jr., Judge.

Oscar Lopez, in proper person.

Charles J. Crist, Jr., Attorney General, for appellee.

Before COPE, GERSTEN and GREEN, JJ.

A life sentence is not impermissible "indefinite imprisonment" for purposes of Article I, Section 17 of the Florida Constitution. See Alvarez v. State, 358 So.2d 10, 12 (Fla. 1978) ("Although no person can predict the maximum length of time which can be served by a prisoner under a sentence of life, this in itself does not render a life sentence impermissibly indefinite.").

Affirmed.
