ORDER


Rogelio Lopez, an inmate at the Columbia Correctional Institution, has filed an application for a writ of habeas corpus pursuant to 28 U.S.C. § 2254. On August 6, 2008, I gave petitioner until August 29th to supplement his petition with facts that show that his custody is unlawful and that he properly raised his third and fourth claims in the state courts or that he meets one of the exceptions for not doing so. Petitioner asked for and I granted a 30-day extension of that deadline. Dkt. 4 and 5.

Petitioner has now asked the court for another 30-day extension, alleging a miscommunication with an attorney whom he thought was going to represent him. I will allow petitioner another 30 days to file a response. However, no further extensions will be granted. Accordingly, petitioner has until October 29, 2008 to respond to the court's August 6th order.
