The record of the trial court's August 13, 2024 hearing in this case regarding appointment of counsel was originally due September 9, 2024. See Tex. R. App. P. 35.1. On September 12, 2024, this court granted the court reporter an extension of time to file the hearing record by September 30, 2024, while noting that no further extensions will be granted absent exceptional circumstances. The hearing record has not been filed with the court. Instead, on September 30, 2024, a second motion was filed for an extension of time to file the hearing record. Because the motion does not describe what exceptional circumstances warrant an extension of time, we deny the motion and issue the following order.
We order the court reporter of the 458th District Court to file the hearing record in this appeal by October 30, 2024. No further extension will be entertained absent exceptional circumstances. The trial and appellate courts are jointly responsible for ensuring that the appellate record is timely filed. See Tex. R. App. P. 35.3(c). If the court reporter does not timely file the hearing record as ordered, we may issue an order directing the trial court to conduct a hearing to determine the reason for the failure to file the hearing record.
We further grant appellant's motion to extend time to file his brief. Appellant shall file his brief within 30 days of the hearing record being filed.
